SECTION 1 — INTRODUCTION

This Terms & Conditions Agreement (“Terms,” “Agreement”) governs your access to and use of the ServiceIQ Pro software platform (“ServiceIQ Pro,” “we,” “us,” “our”).

By creating an account, logging in, or using any part of ServiceIQ Pro, you agree to these Terms.
If you do not agree, you may not use the platform.

ServiceIQ Pro is a subscription-based software platform built on third-party infrastructure and provided to you for your business use.

SECTION 2 — DEFINITIONS

For clarity, the following terms apply:

  • “ServiceIQ Pro” – The CRM, automation, AI, communications, and marketing software you subscribe to.

  • “User” / “Customer” / “You” – Any person or business accessing or using ServiceIQ Pro.

  • “Platform Provider” – Go High Level and its sub-processors, which operate the underlying infrastructure used by ServiceIQ Pro.

  • “Third-Party Services” – External platforms integrated into ServiceIQ Pro (e.g., AWS, email/SMS providers).

  • “Account” – Your unique ServiceIQ Pro environment.

  • “Content” – Any data, messages, files, media, or information submitted or stored by you.

SECTION 3 — SERVICE DESCRIPTION

ServiceIQ Pro provides:

  • CRM & pipeline management

  • SMS & email communication tools

  • Marketing automations

  • Appointment scheduling

  • Reputation systems

  • AI features (AI Employee, Voice AI, Content AI, etc.)

  • Web forms, funnels, websites

  • Reporting and dashboards

Features vary by subscription tier.

ServiceIQ Pro does not guarantee specific business outcomes, customer responses, or lead results.

SECTION 4 — ELIGIBILITY

To use ServiceIQ Pro, you must:

  • Be at least 18 years old

  • Use the platform for lawful business purposes

  • Provide accurate account information

  • Have authority to bind your business

SECTION 5 — ACCOUNT REGISTRATION

You are responsible for:

  • Securing your username/password

  • Managing authorized users

  • Keeping your billing information up to date

  • All activity that occurs under your account

We may suspend access if we detect suspicious activity or policy violations.

SECTION 6 — SUBSCRIPTION TERMS

ServiceIQ Pro is billed on a monthly or annual subscription basis.

By subscribing, you agree:

  • Subscription renews automatically

  • Fees are charged in advance

  • All fees are non-refundable (except as described in Refund Policy)

  • Prices may change with 30-day notice

  • Upgrades take effect immediately

  • Downgrades take effect at the next billing cycle

You authorize ServiceIQ Pro to charge your payment method on file until you cancel.

SECTION 7 — CANCELLATION

You may cancel anytime from your billing portal.

Upon cancellation:

  • Your access remains active until the current billing period ends

  • Your account may be deleted after 30 days

  • Data may not be recoverable after deletion

Cancelling your subscription does not entitle you to a refund unless stated in the Refund Policy.

SECTION 8 — THIRD-PARTY SERVICES

ServiceIQ Pro is built on infrastructure provided by third-party vendors, including Go High Level and Amazon Web Services.

We do not operate or control these systems.

By using ServiceIQ Pro, you acknowledge:

  • Third-party systems store and process your data

  • Outages or breaches originating from these providers are outside our control

  • Their terms, policies, and security standards apply to your data

We are not responsible for their actions, performance, or failures.

SECTION 9 — SHARED RESPONSIBILITY MODEL

Security and compliance are shared among:

ServiceIQ Pro Responsibilities

  • Secure configuration of your account

  • Access controls for our team

  • Monitoring platform notices

  • Communicating relevant incidents

Customer Responsibilities

  • Secure passwords & internal access

  • Proper handling of exported data

  • Ensuring compliance with your own customers

  • Using the platform lawfully

Platform Provider Responsibilities

  • Server-level security

  • Infrastructure monitoring

  • Encryption

  • Threat detection

SECTION 10 — DATA BREACH & INCIDENT NOTIFICATION

If ServiceIQ Pro becomes aware of a security incident affecting your data:

  • We will notify you as soon as reasonably possible

  • We will share updates provided by our Platform Provider

  • We may require you to take action (e.g., password reset)

  • You are responsible for informing your own customers if required

We are not liable for delays or inaccuracies originating from third-party vendors.

SECTION 11 — PROHIBITED USES

You may not use ServiceIQ Pro to:

  • Engage in unlawful or fraudulent activity

  • Send spam, unsolicited communications, or misleading messages

  • Harass or abuse individuals

  • Upload harmful code or viruses

  • Misuse the AI systems or platforms

  • Circumvent platform security or limits

  • Create false accounts or impersonate others

Violations may result in account suspension or termination.

SECTION 12 — LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • ServiceIQ Pro is provided “AS IS” and “AS AVAILABLE”

  • We do not guarantee uninterrupted use or system uptime

  • We are not liable for any third-party service failure

  • Our total liability is limited to the amount you paid in the last 30 days

We are not responsible for:

  • Loss of revenue

  • Loss of data

  • Business interruption

  • Indirect, incidental, or consequential damages

SECTION 13 — INTELLECTUAL PROPERTY

ServiceIQ Pro, branding, tools, templates, and AI systems are owned by Invision Marketing Agency and licensed to you.

You may not:

  • Copy, reverse engineer, resell, or redistribute the software

  • Remove branding, IP, or copyright notices

SECTION 14 — SERVICE MODIFICATIONS

We may update, improve, or modify features at any time.

Some updates may require changes to your workflows.
We are not responsible for modifications made by the Platform Provider.

SECTION 15 — TERMINATION

We may terminate access if:

  • You violate these Terms

  • You misuse the platform

  • Your payment fails repeatedly

  • You engage in fraudulent or harmful behavior

Upon termination, data may be permanently deleted.

SECTION 16 — GOVERNING LAW

These Terms are governed by the laws of North Carolina, USA.

How do I cancel my subscription?

You can cancel at any time through your billing portal or by contacting support.

Do you offer refunds?

Refunds follow our Refund Policy and are not guaranteed for monthly plans.

What happens to my data after cancellation?

Your account will remain active until the end of your billing period, then scheduled for deletion.

What if Go High Level has a data breach?

They are responsible for the incident; we will notify you if your account is affected.

Can I export my data?

Yes. You may export contacts, conversations, and other information anytime.
